Webtrace Terms of Service

NOT LEGAL ADVICE — DRAFT. This document was drafted by the developer as a starting point and has not been reviewed by a lawyer. Review with qualified counsel before launch. Do not publish as-is.

Effective date: 27 August 2026

These Terms of Service ("Terms") are an agreement between you and Dev Rana, an independent developer based in India, doing business as Webtrace ("Webtrace", "we", "I"). They govern your use of the Webtrace Chrome extension, the Webtrace Figma plugin, the .wtrace file format tooling, and any related documentation and websites (together, the "Service"). By installing or using the Service, you agree to these Terms.

1. The Service

Webtrace lets you capture a web page you are viewing in your own browser into a portable .wtrace file, and rebuild that capture as editable layers in Figma. Capture and import run locally on your device; captured page content never reaches Webtrace servers. A Webtrace account (email plus a one-time sign-in code) links your plan and usage allowance across the Chrome extension and the Figma plugin; signing in is required before your first metered workflow. The account service exchanges only authentication, subscription, installation, and usage-count metadata (see the Privacy Policy).

2. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service for your own design and development work. Except as expressly permitted by applicable law, you may not copy, modify, distribute, sell, sublicense, or reverse engineer the Service. The .wtrace file format itself is openly documented; nothing in these Terms restricts you from reading or writing .wtrace files with your own software.

3. Acceptable use — your responsibility for what you capture

Webtrace is a tool. You are solely responsible for what you capture and what you do with it. You agree that:

We may suspend or terminate your access to the Service (including any paid plan, subject to the refund terms below) for material violation of this section.

4. Your content and intellectual property

5. Subscriptions, billing, and refunds

6. Third-party platforms

The Service runs on top of Google Chrome, the Chrome Web Store, and Figma. Your use of those platforms is governed by their own terms and policies, which we do not control. If those platforms change in ways that break or limit the Service, that is outside our control (though we will do our best to adapt).

7. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that captures or imports will be pixel-perfect, complete, uninterrupted, or error-free, or that the Service will work with every web page or every version of Chrome or Figma. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBTRACE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING FROM OR RELATED TO THE SERVICE. TO THE SAME EXTENT, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE IS CAPPED AT THE GREATER OF (a) THE AMOUNTS YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (b) US $50. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Indemnity

You will indemnify and hold Webtrace harmless from third-party claims arising out of your captures or your breach of Section 3 (Acceptable use), including reasonable legal fees, to the extent permitted by applicable law.

10. Termination

You may stop using the Service at any time by uninstalling it. We may terminate or suspend the Service or your license for material breach of these Terms. Sections 4, 7, 8, 9, and 11 survive termination. Your local .wtrace files and Figma documents are yours and are unaffected by termination.

11. Governing law and disputes

These Terms are governed by the laws of [India / to be confirmed with counsel], and disputes will be resolved in the courts of [venue — to be confirmed with counsel], without regard to conflict-of-law rules. [Counsel: confirm consumer-law carve-outs for EU/UK/US customers and whether an arbitration clause is appropriate.]

12. Changes to these Terms

We may update these Terms, for example when new features (accounts, cloud services) launch. We will post the updated Terms at https://getwebtrace.com and update the effective date; material changes will be announced in the product or by email where possible. Continued use after changes take effect constitutes acceptance.
